The US Equal Employment Opportunity Commission (EEOC) recommends that all employers have a strong policy prohibiting sexual harassment. An employer that has a written policy and takes steps to make sure the policy is followed may be able to show that it exercised reasonable care to prevent sexual harassment. An employer that does not follow its own procedures for preventing or investigating sexual harassment may not be able to use this defense.
